The g o a l o f t h e Law E n f o r c e m e n t Assistance Administration ( L E A A ) is t o r e d u c e c r i m e a n d delin quency w h i l e continually improving the quality of criminal justice. The responsibilities of the National Institute o f Law E n f o r c e m e n t and Criminal Justice (NILECJ), the research arm o f L E A A , include research and d e v e l o p m e n t efforts in the prevention o f c r i m e , in the detection of criminal acts, in the identification and a p p r e h e n s i o n o f offenders, a n d in the swift a n d fair adjudication o f s u s p e c t s who a r e arrested and charged. The basic rationale of this research is that by increasing the likelihood of arrest and conviction, the risk associated with the commission of crimes is also elevated. If the risk of criminality becomes sufficiently high, there will be a proportional reduction in the volume and impact of criminal activity. Within the past decade the methods of science and technology have assumed increasingly important roles in efforts to prevent, control and detect crime. One element of the total scientific effort within the criminal justice system assists in establishing that a crime has indeed been committed, in reconstructing the crime, in identifying likely suspects, and in eventually proving or disproving the involvement of a suspected offender with a particular criminal act. This is forensic science. The creation of LEAA followed from the President's Crime Commission Report of 1967 which also recommended the greater utilization of physical evidence in the administration of criminal justice. The greatest proportion of LEAA funds in the forensic science area has been channeled down through the various state planning agencies in the form of block and discretion-

These awards have r e s u l t e d i n t h e c r e a t i o n o f many new l a b o r a t o r i e s a r o u n d t h e c o u n t r y and i n t h e i m p r o v e m e n t o f e x i s t i n g f a c i l i t i e s through t h e a c q u i s i t i o n o f b a d l y n e e d e d e q u i p m e n t and p e r s o n n e l positions. LEAA f u n d s h a v e e n a b l e d s t a t e and l o c a l c r i m i n a l i s t i c s l a b o r a t o r i e s to provide scientific s e r v i c e t o j u r i s d i c t i o n s w h e r e none was available b e f o r e , t o keep pace w i t h the s k y r o c k e t i n g i n c r e a s e i n d r u g s r e q u i r i n g a n a l y s i s , and t o accommodate t h e i n c r e a s e d f l o w o f o t h e r forms of p h y s i c a l e v i d e n c e . F e d e r a l funds a l s o have been i n s t r u m e n t a l i n the development of s t a t e - w i d e crime l a b o r a t o r y systems and c o m p r e h e n s i v e l o n g - r a n g e plans. Over the p a s t f i v e y e a r s at the n a t i o n a l l e v e l , N I L E C J h a s f u n d e d a number o f s i g n i f i c a n t r e s e a r c h p r o j e c t s i n the f o r e n s i c s c i e n c e area. Many o f t h e s e p r o j e c t s have i n c l u d e d t h e r e f i n e m e n t or development o f new t e c h n i q u e s and i n s t r u m e n t a t i o n t o f a c i l i t a t e the examination of p h y s i c a l evidence. Research also has e x a m i n e d t h e o p e r a t i o n s o f l a b o r a t o r i e s and t h e manner i n w h i c h t h e y i n t e r f a c e w i t h o t h e r components of the c r i m i n a l j u s t i c e system. O t h e r r e s e a r c h has c o n t r i b u t e d t o t h e d e v e l o p m e n t o f c o m p l e t e l y new fields, s u c h as v o i c e p r i n t i d e n t i f i c a t i o n , w h i c h a r e now outs i d e t h e s c o p e o f most f o r e n s i c l a b o r a t o r y c a p a b i l i t i e s . I n FY 1973, s e l e c t c a t e g o r i e s o f r e s e a r c h were d e s i g n a t e d as h i g h p r i o r i t y a r e a s : forensic science manpower n e e d s , management and e v a l u a t i o n p r a c t i c e s , and l a b o r a t o r y t e c h n i q u e d e v e l o p m e n t . forensic science laboratories. I t has become i n c r e a s i n g l y a p p a r e n t t h a t t h e r e i s an a c u t e a b s e n c e o f management i n f o r m a t i o n r e g u l a r l y g a t h e r e d by t h e n a t i o n s crime l a b o r a t o r i e s . Very few l a b o r a t o r i e s keep i n f o r m a t i o n on t h e i r o p e r a t i o n s i n a s i m i l a r f a s h i o n ; f o r t h a t m a t t e r , t h e r e i s no a c c e p t e d definit i o n or d e s c r i p t i o n of a crime l a b o r a t o r y . Each s t a t e o r l o c a l l a b o r a t o r y h a s d e v e l o p e d i n i t s own u n i q u e fashion, primarily reflecting the special requirements of t h e j u r i s d i c t i o n i t s e r v e s and t h e i n t e r e s t s and c a p a b i l i t i e s o f t h e crime l a b o r a t o r y d i r e c t o r and t h e chief executive of the l o c a l law enforcement agency. Up t o t h i s t i m e t h e r e h a s b e e n n o a c c e p t e d n o m e n c l a t u r e used t o d e s c r i b e t h e a c t i v i t i e s and output o f forensic laboratories. This absence of u n i f o r m i t y i n b a s i c r e c o r d keeping has prevented t h e c o l l e c t i o n o f d a t a from more t h a n a s i n g l e j u r i s d i c t i o n and t h e c o m p i l a t i o n o f n a t i o n a l s t a t i s t i c s and assessments. T h e r e i s l i t t l e way o f k n o w i n g i f t h e a l l o c a t i o n o f f e d e r a l funds i n t o the f o r e n s i c science f i e l d i n the past s e v e r a l years has been w o r t h w h i l e w i t h o u t such data. Management r e p o r t i n g models a r e needed so t h a t t h e y c a n be i m p l e m e n t e d and o b j e c t i v e e v a l u a t i o n s can be p e r i o d i c a l l y p e r f o r m e d t o m e a s u r e t h e p e r f o r m a n c e and e f f e c t i v e n e s s o f v a r i o u s l a b o r a t o r y configurations and o p e r a t i o n s .

Measures of performance. I n t h e f a l l o f 1973, three crime l a b o r a t o r i e s (Contra Costa County, C a l i f o r n i a ; Dade C o u n t y , F l o r i d a ; and C o l u m b u s , O h i o ) were s e l e c t e d as r e p r e s e n t a t i v e s i t e s f o r t h e development of measures of performance and e f f e c t i v e ness. The P l a n n i n g R e s e a r c h C o r p o r a t i o n , w i t h Mr. L o w e l l ¥. B r a d f o r d a s P r o j e c t D i r e c t o r , was a w a r d e d t h e task of developing a conceptual criminalistics laborat o r y model and methods f o r measuring t h e performance o f such l a b o r a t o r i e s . Teams o f r e s e a r c h e r s e a c h s p e n t t w o months c o l l e c t i n g d a t a on t h e o p e r a t i o n s o f t h e t h r e e p r e v i o u s l y mentioned laboratories. Data were gathered on t h e f o r m s o f p h y s i c a l e v i d e n c e s u b m i t t e d a n d t h e types o f crimes from which t h e evidence had been recovered. Evidence and cases were t r a c e d through t h e l a b o r a t o r i e s as e x a m i n a t i o n s were p e r f o r m e d and r e s u l t s were f o r m u l a t e d . The p r o j e c t i n v o l v e d t h e d e v e l o p m e n t a n d a p p l i c a tion of techniques f o r determining the requirements of crime l a b o r a t o r i e s i n terms of p e r s o n n e l , f a c i l i t i e s , equipment and p r o c e d u r e s . A state-of-the-art c o n c e p t u a l m o d e l was d e s i g n e d t o be f l e x i b l e e n o u g h f o r adaption to jurisdictions with dissimilar populations

The m o d e l i s c o n s i s t e n t "with t h e r e c o m m e n d a t i o n s p u b l i s h e d i n t h e c r i m e l a b o r a t o r y s e c t i o n ( S t a n d a r d 12.2) of the volume, Report on P o l i c e , p r e p a r e d by L E A A s l a t i o n a l A d v i s o r y C o m m i s s i o n on C r i m i n a l J u s t i c e S t a n d a r d s and Goals. The o t h e r p r i m a r y c o m p o n e n t o f t h e s t u d y was the development of l a b o r a t o r y performance measures, f o c u s i n g on t h r e e p r i m a r y f a c t o r s : quality, quantity and r e s p o n s e t i m e . The m o s t s e n s i t i v e p e r f o r m a n c e m e a s u r e was quality, which refers primarily to a n a l y t i c a l c o n t r o l s b u i l t i n t o a l a b o r a t o r y o p e r a t i o n and provisions f o r p r e s e r v i n g the i n t e g r i t y of the evidence and reports. A " p e r f o r m a n c e i n d e x " was developed which s h o u l d e n a b l e any l a b o r a t o r y t o u n d e r t a k e i t s own e v a l u a t i o n and t o p r e d i c t t h e impact o f p r o p o s e d improvements to the l a b o r a t o r y p r i o r to t h e i r a c t u a l implementation. The p e r f o r m a n c e m e a s u r e s r e p o r t i s t o be p u b l i s h e d i n t h e n e a r f u t u r e and w i l l be d i s s e m i n a t e d t o a l l criminalistics laboratories. The r e p o r t , a l t h o u g h an i n i t i a l i n q u i r y i n t o a very complex problem, i s a major c o n t r i b u t i o n t o t h e l i t e r a t u r e and s h o u l d be carefully e x a m i n e d and c r i t i q u e d by a l l c r i m e l a b o r a t o r y professionals. H o p e f u l l y , i t w i l l s e r v e as t h e b a s i s f o r f u t u r e r e s e a r c h and r e f i n e m e n t o f p e r f o r m a n c e models and m e a s u r e s .

Measures of e f f e c t i v e n e s s . Concurrent w i t h the r e s e a r c h to develop measures of performance, the C a l s p a n C o r p o r a t i o n has been d e v e l o p i n g t e c h n i q u e s for measuring the e f f e c t i v e n e s s or impact of crime l a b o r a t o r i e s on t h e c r i m i n a l j u s t i c e s y s t e m . Prior to this study the various uses of c r i m i n a l i s t i c s i n c r i m i n a l j u s t i c e o p e r a t i o n s have not been e v a l u a t e d q u a n t i t a t i v e l y a n d on a c r i m e - s p e c i f i c b a s i s . Even though c r i m e l a b o r a t o r i e s have e x p a n d e d and i n c r e a s e d i n number i n r e c e n t y e a r s , t h e r e i s l i t t l e i n f o r m a t i o n w h i c h shows t h a t t h e q u a l i t y and s c o p e o f l a b o r a t o r y o u t p u t i s s a t i s f y i n g t h e p r a c t i c a l needs and expectat i o n s o f i n v e s t i g a t o r s , a t t o r n e y s and t h e c o u r t s . The C a l s p a n s t u d y , w h i c h i s s c h e d u l e d f o r c o m p l e t i o n i n October, w i l l thoroughly describe the r o l e of criminalistics operations in criminal justice systems. Methods f o r measuring the e f f e c t i v e n e s s of c r i m i n a l i s t i c s o p e r a t i o n s are being developed and v a l i d a t e d . A s e r i e s o f r e c o m m e n d a t i o n s w i l l be d r a f t e d b a s e d u p o n d a t a c o l l e c t i o n and o b s e r v a t i o n i n t h e t h r e e locations. These suggestions should serve to improve the utilizat i o n of c r i m i n a l i s t i c s not only i n the study s i t e s , but in a l l forensic l a b o r a t o r i e s throughout the country.

Laboratory Techniques. In addition to the previous research programs which address t h e personnel and management i n f o r m a t i o n needs o f f o r e n s i c s c i e n c e laboratories, the National Institute i s funding r e s e a r c h t o improve i n s t r u m e n t a t i o n and a n a l y t i c a l techniques applied to the analysis of p h y s i c a l e v i dence. The A e r o s p a c e C o r p o r a t i o n o f E l S e g u n d o , C a l i f o r n i a , a n d t h e Law E n f o r c e m e n t S t a n d a r d s Laborat o r y o f t h e N a t i o n a l B u r e a u o f S t a n d a r d s (NBS) have s e r v e d as p r i m e c o n t r a c t o r s t o t h e I n s t i t u t e i n t h e laboratory technique area. Although space does n o t permit a complete d i s c u s s i o n of a l l p r o j e c t s underway at A e r o s p a c e a n d NBS, I w i l l d e s c r i b e two p r o j e c t areas which are of great interest t o f o r e n s i c science p r a c t i t i o n e r s and r e s e a r c h e r s . Blood and b l o o d s t a i n a n a l y s i s . The A e r o s p a c e C o r p o r a t i o n has completed a survey and t e c h n i c a l assessment of the s t a t e - o f - t h e - a r t of f o r e n s i c serological practices i n the United States. Problems have been d e f i n e d which c u r r e n t l y l i m i t t h e u t i l i z a t i o n o f b l o o d c h a r a c t e r i z a t i o n t e c h n i q u e s , and approaches have been i d e n t i f i e d which have t h e p o t e n t i a l o f s o l v i n g these problems. T h i s a s s e s s m e n t was a c c o m p l i s h e d p r i m a r i l y through contacts with c r i m i n a l i s t i c s laborat o r i e s , blood banks, i n d u s t r i a l organizations which manufacture i n s t r u m e n t a t i o n and reagents f o r b l o o d i d e n t i f i c a t i o n , and t h r o u g h an e x t e n s i v e s e a r c h o f t h e literature. I t h a s b e e n d e t e r m i n e d t h a t a l t h o u g h human b l o o d i s o n e o f t h e m o s t common c l u e m a t e r i a l s f o u n d a t c r i m e scenes, laboratory a n a l y s i s procedures are comparativel y u n d e v e l o p e d i n t h e U n i t e d S t a t e s. The m a j o r l i m i t a t i o n s a p p e a r t o be t h e u n a v a i l a b i l i t y o f s i m p l e and r a p i d m e t h o d s o f a n a l y s i s , t h e l a c k o f h i g h quality antisera prepared specifically f o r dried bloodstain a n a l y s i s , and t h e absence o f blood frequency distribut i o n data f o r the population of the United States. The LEAA-sponsored program at Aerospace, t h e r e f o r e , i s i n t e n d e d t o improve t h e methods f o r t h e d e t e c t i o n o f g e n e t i c v a r i a n t s i n d r i e d b l o o d , t o expand t h e data base concerning frequency of d i s t r i b u t i o n of these v a r i a n t s , and t o design a s t r u c t u r e f o r t h e f u t u r e c o l l e c t i o n and d i s s e m i n a t i o n o f such data. The p r o b l e m s a s s o c i a t e d w i t h t h e p u r i t y a n d s p e c i f i c i t y o f a n t i s e r a may b e s o l v e d b y p r o v i d i n g s p e c i a l inducements t o manufacturers t o go t h r o u g h t h e added expense o f p r o d u c i n g such a n t i sera f o r t h e l i m i t e d market of f o r e n s i c l a b o r a t o r i e s . I n some c a s e s g e n e t i c r e s e a r c h and m e d i c a l t e s t i n g o r g a n i z a t i o n s are or have the p o t e n t i a l of c o l l e c t i n g u s e f u l p o p u l a t i o n frequency data, but u n t i l t h i s t i m e h a v e n o t k e p t a d e q u a t e r e c o r d s o r do not have the i n f o r m a t i o n i n a form a c c e s s i b l e t o forensic laboratories. The d e v e l o p m e n t o f m o r e s t r a i g h t f o r w a r d and l e s s e x p e n s i v e methods w o u l d c e r t a i n l y c o n t r i b u t e t o the g e n e r a t i o n of such data. From what has been l e a r n e d o v e r t h e p a s t year d u r i n g t h i s a s s e s s m e n t p h a s e , The A e r o s p a c e C o r p o r a t i o n a n d i t s s u b c o n t r a c t o r s w i l l b e c o n c e n t r a t i n g now on the development of b e t t e r b l o o d i d e n t i f i c a t i o n methodologies. Improved immunological and e l e c t r o p h o r e t i c m e t h o d s , as w e l l as c o m b i n a t i o n s o f t h e s e and other new m e t h o d s , a r e b e i n g e x p l o r e d f o r a p p l i c a t i o n t o t h e forensic serology problem. O t h e r new b l o o d s y s t e m s w i t h even h i g h e r d i s c r i m i n a t i o n c a p a b i l i t i e s are known b u t h a v e y e t t o be a d a p t ed f o r us e w i t h d r i ed b l o o d . C r i m i n a l i s t s p l a y an e x t r e m e l y i m p o r t a n t role in t h i s b l o o d s t a i n research program. T h i s g r a n t p r o p o s a l was s e l e c t e d f o r funding under t h e I n s t i t u t e ' s Innovative Research i n C r i m i n a l J u s t i c e Program which was i n i t i a t e d this past winter. The p u r p o s e of t h i s p r o j e c t i s t o improve t h e c a p a b i l i t y of crime l a b o r a t o r i e s t o c h a r a c t e r i z e and individualize bloodstains through t h e use of genetic markers. The p r o j e c t i s d i v i d e d i n t o three sections, the f i r s t of which addresses the need f o rp o p u l a t i o n f r e q u e n c y d a t a on t h e newer b l o o d systems, i n c l u d i n g : Phosphoglucomutase (PGM), E r y t h r o c y t e Acid Phosphatase (EAP), MN a n d H a p t o g l o b i n ( H P ) . Over 2,000 b l o o d samples from t h e Greater P i t t s b u r g h Blood Bank w i l l be p r o c e s s e d f o r t h e s e f a c t o r s during the fifteen-month grant period. The second part of t h i s project will investigate the applicability of the isoenzyme s y s t e m s G l u t a t h i o n e Reductase and Peptidase A t o dried blood analysis. The grantee proposes, also, t o incorporate the Gm a n d I n v a l l o t y p e s i n t o r o u t i n e u s e . T e c h niques f o ri d e n t i f y i n g these genetic markers are w e l l - e s t a b l i s h e d f o rwhole b l o o d b u t must be a d a p t e d f o r d r i e d b l o o d a n a l y s i s . Court Acceptance of S c i e n t i f i c Techniques. There c o n t i n u e t o b e p r o b l e m s o v e r t h e a d m i s s a b i l i t y o f new s c i e n t i f i c t e s t s and procedures i n c o u r t . Basically, judges s t i l l employ t h e c r i t e r i a used i n Frye v s . U n i t e d S t a t e s 293 F . 1013 ( D . C . C i r . 1923) , w h i c h r e q u i r e d t h a t new t e s t s m u s t g a i n g e n e r a l s c i e n t i f i c a c c e p t a n c e b e f o r e t h e y c a n be a d m i t t e d i n t o court. W h i l e t h e r e i s no f u n d a m e n t a l p r o b l e m w i t h such c r i t e r i a , d i f f i c u l t i e s do a r i s e when an i n d i v i d u a l s c i e n t i s t o r e x p e r t p r e s e n t s i n f o r m a t i on t o a s i n g l e judge or court. Quite apart from t h e t e s t itself, the d e c i s i o n by t h e court i s i n f l u e n c e d by such v a r i a b l e s as t h e p r e p a r a t i o n and d e l i v e r y o f t h e e x p e r t , t h e competence o f t h e p r o s e c u t o r and defense a t t o r n e y , and t h e a b i l i t i e s o f t h e judge making t h e ruling. The j u d g e i s o f t e n p l a c ed i n a d i f f i c u l t p o s i t i o n b e c a u s e he i s w i t h o u t a d e q u a t e k n o w l e d g e t o decide i f any p a r t i c u l a r t e c h n i q u e has g a i n e d " g e n e r a l scientific acceptance." T h e r e a p p e a r s t o be a n e e d f o r an e s t a b l i s h e d p r o c e d u r e f o r e v a l u a t i n g new t e c h n i q u e s a n d d a t a f o r use i n c o u r t , from b o t h s c i e n t i f i c and l e g a l p e r s p e c tives. Such a procedure s h o u l d r e f l e c t t h e t h i n k i n g of b o t h p r o f e s s i o n s because t h e e x p e r t p o s s e s s e s t h e s c i e n t i f i c u n d e r s t a n d i n g o f t h e t e s t and t h e j u r i s t w i l l be m a k i n g t h e u l t i m a t e d e c i s i o n o f admi s s a b i l i t y . C r i t e r i a s h o u l d be d e v e l o p e d w h ich meet b o t h l e g a l and s c i e n t i f i c a c c e p t a n c e , and p r o c e d u r e s s h o u l d be p r o p o s e d b y w h i c h a n y new t e s t o r s e t o f d a t a c o u l d be e v a l u a t e d . This committee eventually could issue recommendations r e g a r d i n g t h e s u i t a b i l i t y o f any s c i e n t i f i c technique f o r court use. Although not b i n d i n g on a n y c o u r t , t h e f i n d i n g s w o u l d c o n s t i t u t e an i m p a r t i a l a n d c o m p r e h e n s i v e a p p r a i s a l o f t h e t e s t i n q u e s t i o n and p r o b a b l y would be welcomed by most courts i n the nation. P r o b l e m s such as t h o s e encountered i n recent years over v o i c e p r i n t techniques might be a v o i d e d and a l l t h e c o u r t s i n t h e country w o u l d have t h e b e n e f i t o f u s i n g an u n b i a s e d e v a l u a t i o n meeting both l e g a l and s c i e n t i f i c demands. Conclusion The above d i s c u s s i o n has h i g h l i g h t e d t h e f o r e n s i c science program a c t i v i t i e s of t h e National I n s t i t u t e o f Law E n f o r c e m e n t a n d C r i m i n a l J u s t i c e . Current research projects are addressing several critic al problem areas, i n c l u d i n g the education and t r a i n i n g needs o f s c i e n t i f i c p e r s o n n e l , t h e management and e v a l u a t i o n o f l a b o r a t o r y o p e r a t i o n s , and t h e c h a r a c t e r i z a t i o n and i n d i v i d u a l i z a t i o no f p h y s i c a l evidence. E f f o r t s a r e b e i n g made t o e s t a b l i s h p r o g r a m s w h i ch a d d r e s s t h e m o s t s e r i ous p r o b l e m s i n the f i e l d and which r e f l e c t t h e best judgments o f f o r e n s i c p r a c t i t i o n e r s , educators and r e s e a r c h e r s . A l l f o r e n s i c s c i e n t i s t s are encouraged t o maintain an a c t i v e i n t e r e s t i n t h e p r o g r a m s o f t h e I n s t i t u t e and t o b r i n g c r i t i c a l p r o b l e m a r e as a n d new c o n e e p t s for research t o i t s attention.
